Account Terms

  • Brown Hosting provides web hosting to clients worldwide, and we have a responsibility to protect each client and to provide the best services available. All clients of Brown Hosting are subject to the following terms of service:We will setup your account after we have received full payment Please note that the DNS (nameservers) can take up to 48 hours to update with your new hosting plan after you have set them up. But, approximately, will be updated within minutes

    Indemnification Policy:

    You agree to use all Brown Hosting services and facilities at your own risk. Brown Hosting specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall Brown Hosting be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold Brown Hosting harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against Brown Hosting, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it’s agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Brown Hosting against liabilities arising out of Any injury to person or property caused by any products sold or otherwise distributed in connection with Brown Hosting’s server.

    Brown Hosting reserves the right to intervene with any of the sites hosted on its servers in the interest of its customers. Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party Copyright infringement any defective products sold to customer from Brown Hosting’s server. Brown Hosting shall be the sole judge of what violates this Policy.

    Billing:

    At this time we bill monthly, quarterly, semi-annually and annually, depending upon the plan.

    We accept Visa, Master Card, American Express, Discover Card and paypal. For webhosting plans we will not setup your account without any pay. Clients are encouraged to pay by paypal as it is the easiest way to handle payment at this time. Their are no contract periods but for each successive period, your contract is automatically renewed unless we are notified otherwise.

    Late Payments:

    All accounts are billed according to the dates they were first activated on. If you will not pay for service renew in 2 days after deactivation, your account will be suspended. If you will not pay for service renew in 30 days after deactivation, your account will be terminated. You will receive an email reminder 5 days till deactivation.

     

    LIMITATION OF LIABILITY:

    Brown Hosting shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Brown Hosting servers going off-line or being unavailable for any reason whatsoever. Furthermore, Brown Hosting shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Brown Hosting servers. All damages shall be limited to the immediate termination of service.

    PUBLIC FEEDBACK:

    We have a zero tolerance policy for posting negative feedback on any public locations about our company and/or our employees before submitting a ticket to our “Suggestions & Complaints” Department to discuss your issue, this will result in immediate account termination without any refund. Although it is your right to post feedback without discussing your issue with us first, it is undoubtedly unfair and unprofessional not to, which is not the type of client that we want to deal with. We have the utmost respect for all of our clients, and are more than fair with all of our clients. We will do anything and everything possible to keep all of our clients satisfied. But in the unlikely event you are not satisfied, all that we ask is to discuss your issue with our Complaints Department first. For example, if you are the type of person to run to the forums at the first chance you get to complain, please DO NOT SIGNUP with Brown Hosting in the first place.

    REFUND POLICY:
    Brown Hosting has a NO REFUND policy. All sales are final. There are no refunds. Service fees are non-refundable. For cancelled memberships which are being paid for on a monthly basis, billing will stop at the time of cancellation. By making a purchase on Brown Hosting, you acknowledge that you have read and agree to the Brown Hosting No Refund Policy

    SERVICE CANCELLATION:
    Service cancellation requests for the following month must be submitted prior to your following month invoice generating, which typically occurs 14 days prior to your anniversary date. By canceling in advance you avoid being responsible for the next month of service. Cancellations that are submitted after our 14 day notice requirement, will still be subject to any fees for the next billing cycle where notification was not given, your service will terminate after the end of your next billing cycle.

    DISCLAIMER:

    Brown Hosting cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by Brown Hosting are resold. Thus, certain equipment, routing, software, and programming used by Brown Hosting are not directly owned or written by Brown Hosting. Moreover, Brown Hosting holds no responsibility for the use of our clients accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as Brown Hosting sees fit. FURTHERMORE, Brown Hosting retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification. You are responsible for backing up your site. We are not responsible for lost files.
